The first section of the Supreme Court of Brazil approved on March 8 the extradition to Italy of Rocco Morabitosaid Tamunga 54, the drug trafficker of the ‘Ndrangheta considered the second most dangerous fugitive after Matteo Messina Money. In May 2021 Morabito was arrested by the federal police in João Pessoa, and was therefore transferred to the federal penitentiary in Brasilia, where he is currently being held.

The decision of the first section of the Brazilian Supreme Court which authorized the extradition of Rocco Morabito to Italy was unanimously adopted by President Carmen Lúcia and by judges Alexandre de Moraes, Luís Roberto Barroso and Rosa Weber. It is difficult for the defense of the ‘Ndrangheta boss to find other quibbles to delay its execution, so the dossier should now be transferred to the President of the Republic Jair Bolsonaro who will have to sign it and ensure that the Ministry of Justice initiates the required procedures from the Italian-Brazilian international cooperation treaty.

Brazilian media reported that Morabito’s lawyers had tried to prevent extradition by arguing, among other things, that their defender was persecuted in Italy. At the same time, the Italian boss had also submitted an application for political asylum to the Brazilian government. The judges of the Supreme Court have assessed that the sentences imposed by Italian justice concern common crimes, not political ones, and that “Italy is a democracy”.
Before the hearing began, Morabito’s defense asked President Carmen Lúcia to remove the case from the trial agenda, transferring it to the next session.

The argument was that there is an “imminent decision by the Inter-American Court of Human Rights, called into question to verify an alleged illegality of the Italian justice procedures, in addition to the fact that the Brazilian government had not yet ruled on the asylum request. However, this request was not accepted by the judges of the Court.
