How the President of the Republic is elected during a pandemic – RB

The election of the new President of the Republic is the topic that everyone has been talking about for weeks now. Mattarella, who has already made it known that he is not interested in a new mandate, will therefore be permanently replaced (by whom? We tried to understand it here, focusing on the most “popular” names at the moment). But how is the Head of State elected, as well as Guarantor of the Italian Constitution? And above all, Does the state of emergency change anything? To these and many other questions our readers have asked us to answer.

Therefore, let’s try to clarify.

How the President of the Republic is elected

As established by the Constitution, in Title II art. 83: ” The President of the Republic is elected by the Parliament in joint session of its members “. The members of the Chamber of Deputies and the Senate of the Republic participate in the vote, together with the delegates elected by the Regional Councils (each Regional Council elects three delegates so that the representation of minorities is ensured. Valle d’Aosta has only one delegate).

The convocation in joint session of the Parliament and the regional delegates to elect the new President of the Republic is carried out thirty days before that the term of his mandate expires and is carried out by the President of the Chamber of Deputies. If the Chambers are dissolved, or if their termination is less than three months, the election takes place within fifteen days of the meeting of the new Chambers. In the meantime, the powers of the President in office are extended (art. 85, Constitution).

The election takes place by secret ballot . In the first three ballots a two-thirds majority of the assembly is required, from the fourth the absolute majority is sufficient (or a number of votes greater than half of the total number of all those entitled to vote, present and not).

When Parliament meets in joint session, the Rules of the Chamber of Deputies apply. The President of the Republic, before taking up his duties, takes an oath of loyalty to the Republic and observance of the Constitution before the Parliament in joint session (art. 91, Cost.).

Any citizen who has reached the age of fifty and enjoys civil and political rights can be elected President of the Republic . Since the office of President of the Republic is incompatible with any other office, the new Head of State has the right to receive an endowment whose amount is determined by law (here the exact amount).

Elections of the President of the Republic: does anything change with the pandemic?

The state of emergency , in fact, does not change the rules of the Constitution. Therefore, the procedures for election of the President of the Republic remain the same, also during the pandemic .

Deputies and senators who will meet in the Chamber to vote, however, will be called to respect the anti-contagion rules currently in force force. All 1009 major voters must therefore be in possession of a Green pass (even just the basic one, obtained as a result of a negative swab), wear a mask FFP2 (mandatory) and, before entering the classroom, have a body temperature lower than 37, 5 ° (which will be measured by professionals ).

Furthermore, during the vote, everyone must respect the safety distances and remember to sanitize their hands correctly and minimize the opportunities for contact, which could cause transmission of the virus.
